Artificial Intelligence Disclosure and Safety Act: AI companion provisions · SB 3001 CD1; Act 248, Session Laws of Hawaii 2026

In force: Effective and enforceable today. · AI companion · effective 2026-07-14 · binds operators

Ages: All users; heightened duties once the operator knows or is reasonably certain a user is a minor (under 18)

Requires: Operators of an 'AI companion' (a system designed to simulate a sustained human-like relationship by retaining cross-session information to personalize engagement, asking unprompted emotion-based questions, and sustaining ongoing dialogue on matters personal to the user; all three prongs required) must disclose that the user is talking to AI whenever a reasonable person could be misled, and maintain crisis protocols (self-harm detection, crisis-line referral, no posing as a licensed mental-health provider). For known minors: persistent or at-least-hourly AI disclosure with break reminders, no unpredictable-reward or anti-disengagement engagement tactics, safeguards against sexually explicit content directed at the minor, and parental screen-time and account tools. Annual de-identified reporting to the Dept. of Health begins 2028-01-01. AG-enforced under HRS 480-2; no private right of action. Task-based assistants and customer-service bots fall outside the conjunctive definition.
